Terms & Conditions

Company Role and Service Structure


Recommended Inspections LLC (“Company,” “we,” “us,” or “our”) operates as a private coordination and referral service. We connect property owners and other clients (“Client” or “you”) with independently licensed and insured third-party inspection professionals (“Inspector”).

Recommended Inspections LLC does not perform inspections, construction services, engineering services, code enforcement services, or municipal inspection services.

All inspection services are performed solely by independent third-party Inspectors.


Independent Contractor Relationship


Inspectors referred through our platform are independent contractors and are not employees, agents, partners, or joint venturers of Recommended Inspections LLC.

We do not supervise, control, direct, or guarantee the work, findings, opinions, reports, or conclusions of any Inspector.

Any inspection agreement, scope of work, fee agreement, or service contract is strictly between Client and the selected Inspector.


 No Government Affiliation


Recommended Inspections LLC is a private company and is not affiliated with, endorsed by, or acting on behalf of any city, county, state, or federal government agency.

We do not issue permits, conduct municipal inspections, or enforce building codes.

Any references to publicly available permit information are derived from public records and are used solely for informational purposes.


 Scope and Limitations of Inspections


Inspection services provided by third-party Inspectors are limited in scope and may include visual observations of visible and safely accessible areas at the time of service.

Inspections:

  • Are not technically exhaustive
  • Are not engineering evaluations
  • Are not guarantees of workmanship or performance
  • Do not ensure code compliance
  • Do not predict future system performance or lifespan
  • May not identify concealed, latent, or future defects

Clients must review and rely upon the specific inspection agreement provided by the selected Inspector for full scope and limitations.


No Warranties


Recommended Inspections LLC makes no representations or warranties, express or implied, regarding:

  • The quality of inspection services
  • The accuracy of inspection findings
  • Contractor workmanship
  • Code compliance
  • Property condition
  • Future performance of any structure or system

All services are provided “as is” without warranty of any kind.


Limitation of Liability


To the maximum extent permitted by law, Recommended Inspections LLC shall not be liable for:

  • Any inspection findings, omissions, or errors
  • Property damage
  • Construction defects
  • Contractor disputes
  • Economic loss
  • Consequential, incidental, special, punitive, or indirect damages

If liability is imposed notwithstanding this limitation, total liability shall not exceed the amount of any referral fee received by Recommended Inspections LLC for the specific transaction at issue.


Indemnification


Client agrees to indemnify, defend, and hold harmless Recommended Inspections LLC, its members, officers, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of:

  • Inspection services performed by a third-party Inspector
  • Disputes between Client and contractor
  • Client misuse of inspection reports
  • Client’s breach of these Terms

Dispute Resolution and Arbitration


Any dispute, claim, or controversy arising out of or relating to services coordinated by Recommended Inspections LLC shall be resolved exclusively through binding arbitration.

Arbitration shall be conducted in the State of Montana unless otherwise agreed in writing.

Client waives the right to trial by jury and participation in any class action proceeding.

Each party shall bear its own legal fees unless otherwise awarded by the arbitrator.


Governing Law


These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Montana, without regard to conflict of law principles.


No Professional Advice


Information provided on this website or in written communications is for informational purposes only and does not constitute engineering, legal, construction, or code enforcement advice.

Clients should consult appropriate licensed professionals for technical or legal determinations.


Public Records Information


Any property or permit information referenced in marketing materials is derived from publicly available sources. While we strive for accuracy, we make no representations regarding the completeness or current status of such information.


Severability


If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.


Modification of Terms


Recommended Inspections LLC reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on this website with a revised effective date.

Continued use of our services constitutes acceptance of the revised Terms.


Acceptance of Terms


By requesting inspection coordination services, scheduling an inspection, or otherwise engaging with Recommended Inspections LLC, Client acknowledges and agrees to these Terms and Conditions.
